Solution For Timeshare, a company linked to ITRA, claims to offer a “legal cancellation” of timeshare contracts to owners.
Following a complaint by KwikChex about the testimonials featured on the company’s website, in which it challenged whether these were genuine, http://www.solutionandfortimeshare.com/, the ASA carried out an investigation. It is also noted that similar testimonials, with different names and locations, also appeared on the Swedish version of their website, www.slappdintimeshare.com.
Solution for Timeshare did not respond to the ASA’s enquiries and the ASA was concerned by its lack of response and apparent disregard for the Code which was a breach of the CAP code (Edition 12) rule 1.7.
The ASA noted that Solution for Timeshare had provided no evidence relating to the voracity of either the English or Swedish testimonials of why they appeared similar. Because the ASA had not seen evidence to demonstrate that the testimonials were genuine, it concluded that the ad was misleading.
As a result, the advertisement must not appear again in its current form and Solution for Timeshare were told to ensure that they held evidence that their testimonials were genuine and then referred the matter to the CHP compliance team.
