Supreme Court Rulings 2015: Update

Last year there were two Supreme Court rulings made against Anfi in which two perpetuity contracts were declared null and void on the basis that the membership was for a duration of more than 50 years. RDO concurred with Anfi's conclusion at the time that there had been a misinterpretation of the law in Spain as it applies to timeshare schemes in existence before Spain implemented the provisions of the first Timeshare Directive in 1998. Clarification was sought by Anfi earlier this year from the Property Register and Notary Head Office, which was responsible for authorising the registration of the pre-existing schemes of the Anfi resorts, which enabled them to continue to offer timeshare contracts of unlimited duration. From Aha to Kerching!

The title of Guy Browning’s presentation on Day 2 of RDO6 at the Don Carlos Hotel in Marbella, Spain, somehow sums up this year’s conference - more on that presentation later. This year I think those of us on the Conference working group were seriously concerned as to whether we could produce an event that exceeded the standard reached in London last year at RDO5. We need not have been so worried. From Michael Jackson’s (the other one) opening, which so accurately reflected the theme for this year of “Embracing Change” and taught us how not to over-complicate things, to resist the negativity in our thinking and identify what is important to our businesses. RDO6 2015 Conference – What Is On The Agenda?

With just over a week to go to this year's Conference RDO6 “Embracing Change” in Marbella, it hardly seems possible that a whole year has flown by since we all gathered for 2014's "must not miss" European timeshare conference of the year. Always Look On The Bright Side Of Life…..

So the song goes, and when we heard last week of the second ruling of the Spanish Supreme Court against Anfi Sales, it is fair to say there was a degree of disappointment, but after some initial reflection and review, the Python’s song title comes to mind and we need to move forward. The first ruling against Anfi Sales baffled most lawyers in the industry, as it appeared to fly in the face of the transitional provisions that the domestic Spanish legislation put in place back in 1998 to allow for existing timeshare schemes that were for more than 50 years. The End Of April…. Hold The Front Page…..

Anyone who is a film buff will remember the 1974 Billy Wilder version of the 1931 film – The Front Page. The ’74 film starred Walter Matthau as the Editor and Jack Lemmon as his star crime reporter. It was originally a successful stage play and the fact it has been filmed I believe four times is testament to its success, needless to say I believe that Matthau and Lemmon produced by far the best and funniest version. The only reason I mention this, is because when it gets this late in the month and I haven’t written the monthly Blog, anytime now I (aka the hapless Lemmon) am going to get Nikkie (aka Matthau) emailing to know where it is  and why hasn’t it been written! Spanish Supreme Court Ruling 15 January 2015

We are aware of the ruling of the Supreme Court in Spain regarding the case of Anfi Sales SL v Grimsbo. We have been in and continue to be in close touch with Anfi management and their legal advisers to ascertain the up to date position. We understand from intensive discussions with Anfi’s legal advisers, and concur with their conclusion, that there has been a misinterpretation of the law in Spain as it applies to timeshare schemes in existence before Spain implemented the provisions of the First Timeshare Directive in 1998. We therefore believe, as does Anfi, that this case has limited applicability, as the law was further clarified in Spain in 2012, when it implemented the Second Directive and confirmed the validity of existing schemes of whatever duration – a point...

Claims Directive cases rejected by Spanish court for fifth time

The Anfi group has reported that cases filed by owners represented by Claims Directive were rejected by a judge in Las Palmas (Canary Islands). This is the fifth ruling in favour of Anfi regarding similar claims.   Anfi reports that Claims Directive has been targeting its members offering them legal assistance in cases against the group, with the promise of recovering a higher amount than their initial investment. Potential claimants are asked to pre-pay legal expenses of up to 6000 euros, and will often be liable for huge costs involved in long drawn out court cases.   Anfi warns that claimants who lose their case will be obliged to meet not only their own legal costs but also the court costs and those of Anfi, and advises its members to carry out exhaustive research...
